These terms are between you and Kury Enterprises, LLC ("we", "us") and apply to SimpleBU, SimpleBU Sentinel and SimpleBU Unattended (the "Software") and to this website. By installing or using the Software you agree to them.
We grant you a non-exclusive, non-transferable license to install and use the Software on computers you own or control, for your personal or internal business use. A paid license is perpetual for the version you purchased and its updates in the same major version. You may not sell, rent, sublicense or publicly share the Software or your license key, and you may not remove license checks or use keys that were not issued to you.
Each product may be used free for 30 days from its first run. After the trial, creating new backups requires a valid license key. Restoring files and reading existing backups never requires one.
Orders are processed by our payment partner, which acts as the seller of record and collects any applicable sales tax or VAT. Your license key is delivered by email. Keep it safe; we can re-send it on request.
The Software copies files you select to locations you select. You are responsible for choosing sensible sources and destinations, keeping your backups on a different drive from the originals, and testing that you can restore from them. No backup method can guarantee that data will always be recoverable.
The Software is licensed, not sold. We keep all rights not expressly granted. You keep all rights to your own files.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Software will be error-free or that it will prevent data loss.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KURY ENTERPRISES, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, PROFITS OR BUSINESS, ARISING FROM USE OF THE SOFTWARE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.
This license ends automatically if you breach these terms. You may end it at any time by uninstalling the Software.
These terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules.
